As far as I understand such things (and I'm a part time photographer, not a lawyer), international property law dictates that any image is automatically copyrighted whether explicitly stated or not. Indeed, it is explicit mention that an image is in the public domain that makes it available for appropriation. Even protected images may be used within the context of fair use clauses, but those normally apply to journalistic and academic endeavors, not simply "no money is being made." As noted, however, I am not a lawyer, so none of this should be construed as legal advice.

This is correct. Almost every porn site gives out free promotional images that are used on so-called TGP sites like the ones in this thread. Those are either free of copyright claims or tied to a so-called webmaster program which we can then sign up for. If we notice that an image is published without the owners permission on Milovana we just take it down and ask the author to find an replacement. Same thing if we receive complaints about an image or a series of images. :-)

And I want to add one small but important point. If there is an amateur photo published, the model should always agree. So please don't use pictures of your ex or other private pictures if they don't agree to.

Wowooahoa. Be very careful with amateur images. For example, if you're living in the United States, you also need a 2257 record. I think that consists of a copy of the ID and a form signed by the model. But if you really want to do this I strongly suggest you get a lawyer first anyway.

Okay, so is it okay to go ahead and use free promotional images from sites and images from TGP sites? (Sites other than the links in this thread you mention). How do we know if the images are free of copyright claims or tied to a webmaster program? If the latter; do we contact the Milovana team and ask them to sign up to the program?

Yes. If the site looks proper and if they state their sources, you should generally be fine. Most of the sites we recommend will always state their source, either per gallery or on a special page for the whole site.

Sure, why not. But one company usually runs lots of sites, so all the different sites that put out these images pretty much come back to only a handful of companies. So with just a few contracts we can cover most images you guys come up with. But, definitely if you think it's a new one let us know.

I know I have to be very careful about saying this, but guys... just use some freakin' common sense. If you take a hundred pics out of the closed member section of a paysite -> very bad idea. Take a few pics with little watermarks on them from a gallery that's plastered with advertisements for that same site -> probably promotional. I've talked to guys who work for paysites. Free sites like us are making them a lot of money. Within those webmaster programs they pay sites like us 10-40% (some even more) of their income for every guy who signs up with them. They try very hard not to piss off the big free sites. Sure, you ABSOLUTELY 100% have to respect their members-only material, but other than that, they are thankful for every dude you get hooked on their stuff.

(Just to clarify this: We are not taking any money in through those webmaster programs at the moment, mostly because I'm too lazy to deal with the necessary British and Dutch paperwork. ;-) )

Seraphox: awesome. Thanks for the lengthy reply. Buried in exam pressure at the moment but will try to lose my webtease-virginity ASAP!
