Copyright fears, uncertainty, and doubt seem to arise in many conversations at Milovana. For context, this community is in the same arena as those that generate Anime Music Videos (and the latest fad, Pony Music Videos), with the added consideration of mature content. There are an abundance of lawyers and academics that have weighed in on the status of the other community's content as it relates to the fair use defense, liability, and practical concerns (at least as it relates to the United States).Mr123 wrote:Ch-vids are more or less i***gal, so I doubt it would be a good idea to actively seek for video-producers/editors.
Active promotion of the genre to recruit those most capable of creating videos would not be illegal if done by users. The site itself through acting on its policies has a strong DMCA safe harbor defense, such that actions/content provided by its users is ever argued to have committed or encouraged infringement would not transfer liability to it.
Artists creating videos however do carry a risk that they could be extorted (pushed to a settlement, prior to any effective opportunity for defense), if there is an interest hired to act on part of a copyright holder for financial gain. It's their judgement call on degree of exposure to this risk after being attracted to the community - those seeking their involvement would not carry weight of liability in this individual judgement.
