In some jurisdictions, just being a peer is considered broadcasting, even if there's no leech. Broadcasting isn't bad in itself, it's just what is being broadcast that may be an issue. And authorities can find out easily, and also ISPs that also sell streaming subscriptions. :devil:
That is true, and it's something to be cautious about when downloading torrents. Peers share the same risk as the original uploader. If anything that lowers the risk for the original uploader though - they are a random face in the crowd, rather than a single target.

I'm not aware of any test cases yet, but block-chain based storage will potentially face the same issue. If the data stored on your machine is being uploaded to someone else at any point, that can be considered broadcasting copyrighted material. Lower risk for now, but that's only because it's not big enough to be targeted yet.
