That is true, and it's something to be cautious about when downloading torrents. Peers share the same risk as the original uploader. I'm not aware of any test cases yet, but block-chain based storage will potentially face the same issue. If the data stored on your machine is being uploaded to someone else at any point, that can be considered broadcasting copyrighted material. Lower risk for now, but that's only because it's not big enough to be targeted yet.
