Hello all,

Recently i have received papers from Malibu Media telling me that i have infringed their copyright videos. They have filed a case in Federal Court. I was wondering if any of you had dealt with this kind of thing before and if so how did it pan out? I assume i need to get a lawyer. Any advice for me?

First, edit this post and cleanse the name of the company and how you came across the videos. Do not admit to anything in anywhere online which could be found and used against you. Keep the request for advice generic.

Find a lawyer and tell them the circumstances.
You would likely also want to delete any copies of your works offline which are the target of this case.

Well first off do your homework. Find out who owns the company and if they are legit. Its always good to know who runs the company as if this fails you can counter sue the owner for damages and distress.

If they are legit try and try to find cases were they have been successful to gauge if this is to go anywhere or if you take a hard stance against them they will back down.

Also reply back stating your not done anything. Ask them for full evident of your supposed copyright infringements as I'm sure they will have to provide you with this before hand.

You want them to give you each count of infringement along with IP address you have supposed to connected to with the Torrent and times/dates also have them state how they came across this information as i doubt it may be highed as legal for the purposes of evidence in court.

Also get them to send you the federal court reference number once you have this check that they have actually filed a case your best to have this so you can view the court proceeding papers for yourself.

It seems this company is in it for the money so its your job to get as much information out of them as possible and hope they get the message that it will be more hassle than its worth to carry this action out against you. As most bit torrent cases like this the evidence is flaky at best.
