I think you should just remake it and in comment you write something like "remade from original blahblahblah tease by This Man"
Or something like that. I don't think someone would object.

Yeah the author last logged on September 2009. Not sure if they will suddenly return after nearly a year.
It would probelby be okay if you gave credit like nezhul said.
It would be good as a flashtease, especially if you add the music to play automatically instead of having youtube links (cos you cant copy and paste links in flashteases)

yeah there might be copyright I dunno, but searching for the youtube video might be a way around it, or pick a public domain song instead

I personally have no real objections to anyone remaking any of MY teases.
I just ask a few things:
1) They spell everything right.
2) They use pretty much the same style and premise that I used.
3) They DO A GOOD JOB!

Firstly, even if the author returns after a year - I doubt he would be against a flash version of the tease.
Now, about copyrights. First of all, Youtube holds no copyrights of their material, and there's a lot of illegal stuff too. The owner of your music probably have some rights, but as far as he doesn't care about youtube - I don't think he'll care about Milovana. So get the audio (find it separately or extract from youtube videos) and embed it into a tease. I don't think it would be a good idea to embed the whole video. Better some sexy pictures.

A Milovana author would probably be flattered of a remake, but as for the song it is a totally different matter, anyone who posts anything of his own on youtube holds its copyright, and if it is not his he should have the permision of the owner (like posting a video made by a freind). So linking or embading from youtube is totally legal, but having a copy on Milovana's server is absolutely not, except with the permission of the owner. And in case the owner used illegal material in his video it is his problem, but still the original owner can still ask you to stop publishing his work, and this can damage you it is the youtube user who is responsible if he gave you permission.
NOTE that some (but not all, check with some lawyer or law reference book) permissions should be writen and signed in a legal form to have value.
And if you want to republish in total legality a tease by a virtual user (as long the real person doesn't claim being the owner of his nickname) if he doesn't reply you should have to wait something like 50 years from publishing day (time delay might change depending of the country). And if it is a real person some countries extend the delay from 50 to 100 years after authors death (copyright system, as in usa, give 50 years after publishing)

Forget about copyrights! Noone really care, you know, and I doubt any layer would go to the court yelling "Hey! I'v been doing this orgasm-denial tease on Milovana lately, and they have illegal sound embedded there!!!"
By the way, didn't anyone think that 99% if not 100 of pictures in the teases are someones property too? Wanna discuss that?
Be real people. Just do what you like, it's the internet afterall, and not poliece department.

Looooooooooooool, even if any lawyer would do it, he has no right doing it, only the copyright holder,or his lawyer, can do it.
Then there is a difference between free preview pics who's owners would be happy with some free advertisement and songs. Espacially that production houses are fighting everyday agains internet law infridgments, and government enforcing more and more the laws concerning multimedia illegal publishing. In some countries people can be arested for bringing at the airport an illegal copy of some song album, or sharing copyrighted material via peer to peer.
And they might be really unhappy about their songs being used for masturbation purposes, some people in that world think it is baaaad

Sop it is better to find it some place over youtube (with a still image to reduce bandwidth use) and let the youtube user take all the responsability.

Serious - no, definiterly not. The very most that'g going to happen is they ask you to remove the content. But before that all torrents and filehost's will be brought down - I seriously doubt someone would fuck quite a lot with law enforcement in the case of the one song on a small-community site like Milovana (no offence, but it could not be compared to how much copies of this song will be watched on youtube, downloaded at piratebay or rapidshare...

I think you look too much inthere and read this new laws too literally. If they make such a law it doesn't mean they can enforce it. That's the problem why internet piracy hasn't been shut down years ago and won't be shut down years further.

Piracy is still standing because it is on servers in country outside the law inforcing countries, and hard to detect on P2P unless every production house get a bureau to search every other day for their products.
And then yes a harmless use (not ewven offering the download) as on milovana would probably be just asking for removal. Then youtube has always law issues, and that's why they make it clear that users are reponseble not them, and cooperate no arguing with the law.
I know this sucks, but there are so many money hungry poeple outside. An to avoid issues maybe it would be better to use songs that are very easy to find on P2P, and do never use on milovana music you paid for, just get it from peer to peer.
