My CH removed from Pornhub

Hopefully this doesn't mean the end of our videos on the web, I wish I knew exactly what triggered the removal. All I know is XTakeDowns requested the video be taken down. No video was shared at full length and they were all obtained from free sites. I can only guess maybe this is tied to the video being sold in Japan without my permission by someone I don't know.

The Japanese site probably claimed ownership of the file and sent a takedown to Pornhub. It is disgusting, but people/businesses do this all the time. Pornhub and other sites typically don't want to get involved in legal disputes over who the rightful owner is, so if they get a takedown notice, they immediately take it down.

Maybe, but they would have probably sent it directly to pornhub. My guess is XTakeDown has some sort of file clip sniffing code that scans the web based off their site description. My other site uploads are good. I recently uploaded it to pornhub so maybe this is a new tech for them.

I had one of my CH's taken down on Pornhub by a DMCA request from Brazzers, but I immediately re-uploaded it with no changes and it's been up for longer than the original upload was. Maybe it's just the luck of the draw and you could try again?

I could, but I feel like it's tempting fate. Not from legal action, but why promote our videos further and draw more negative attention if not necessary? I know they are still available from other realms, I think I will leave this one alone.

Keep in mind that CH videos are at best stretching the definition of fair use, and if ever brought up in court would most likely be ruled breach of copyright. And even if the short video clips would qualify, the use of commercial music in most CH videos would land you there as well. CH videos are awesome, but if any company happens to spot their content in them, they’re free to issue DMCA statements to have sites take the videos down. Generally speaking, companies won’t go further than that, though, and I think it’s hard for them to keep up with the rate that content is posted (not CH specifically, but non-legit postings of their work), so most videos, especially if they’re not obviously stolen content will slip through the cracks. But I assume that video companies use software or services that is able to search videos for their content through automation, so I would never be surprised to suddenly find a video taken down. Most likely, it’s pretty random whether a video is taken down quickly or much later.
